Netherlands EU Permanent Residence: 5-Year Rule, €85 Fee and 90-Day Decision
Official-source verification date: 27 May 2026. This date applies to every fee, eligibility threshold and processing period stated below.
The Dutch Immigration and Naturalisation Service (IND) states in Permanent residency for Union citizens and their family that the standard Netherlands route for EU/EEA/Swiss nationals and qualifying family members requires 5 years of continuous residence in the Netherlands, during which the applicant worked or had enough money to live on (threshold checked 27 May 2026). The stated application fee is €85; the normal decision period is 90 days and may be extended, while an issued residence document is valid for 10 years for an adult or 5 years for someone under 18 (fee and periods checked 27 May 2026). This is the IND’s EU/EEA/Swiss “permanent residency” route rather than the ordinary Dutch permanent-residence process; the cited page does not provide the ordinary process’s eligibility test, fee or decision period, so those figures should not be generalized to it.
Is this the same as ordinary Dutch permanent residence?
No. The document type covered here is “EU/EEA, permanent residency Union citizens”, not a decision rule for every Dutch permanent-residence application. Eligibility under this route is connected to EU/EEA/Swiss nationality or an eligible family relationship.
The IND lists sections 8.17 to 8.20 inclusive of the Aliens Decree and Directive 2004/38/E as legal sources for this route. It also expressly states that family members and ex-partners of a Dutch national who comes under EU law come under EU law.
The terminology matters. The IND page says that someone holding a residence permit for residence with a minor Dutch Child under the Chavez arrangement cannot apply for this EU/EEA/Swiss permanent-residency permit, but may apply for a permanent residence permit or a residence permit for long-term EU residents. An ordinary Dutch permanent-residence application therefore cannot be assessed from the eligibility rules, forms, fee or timing for the EU/EEA/Swiss route.
Who qualifies for the EU/EEA/Swiss route?
The IND page covers:
- A national of an European Union, European Economic Area or Switzerland country.
- A person with another nationality who is a family member of a Union citizen.
- A family member or ex-partner of a Dutch national who comes under EU law.
The applicant must also have a valid passport or other travel document and be registered in the Personal Records Database—BRP—with the town hall in the area where they live.
Which family members may qualify?
For the Union-citizen and EU-law-covered Dutch-national routes, the IND lists the following relationships:
| Family relationship | IND requirement |
|---|---|
| Married, unmarried, registered partner or ex-partner | The relationship is included in the listed family categories. |
| Parent, parent-in-law, grandparent, child, grandchild or great-grandchild | The relationship is included in the listed family categories. |
| Uncle, aunt, cousin or another family member | The family member must satisfy one of the conditions below. |
An extended family member such as an uncle, aunt or cousin must meet one of these conditions:
- Financial dependence: The person depends on the applicant financially and regularly receives money from them—for example, enough to cover basic needs such as rent, food and drink.
- Serious health care: The person needs care from the applicant because of serious health problems.
- Dependence and prior cohabitation: The person depends on the applicant and was already living with the applicant in their country of origin.
These categories establish potential eligibility only; the applicant must also satisfy the residence, documentation and application requirements.
What does the five-year work-or-resources test require?
| Element | Requirement under the IND page | Checked |
|---|---|---|
| Residence | Living continuously in the Netherlands for 5 or more years at the time of application | 27 May 2026 |
| Work or resources | During that period, the applicant worked or had enough money to live on | 27 May 2026 |
| Family-member route | A family member or ex-partner must have met the residence requirements for Union citizens for 5 years | 27 May 2026 |
| Provisional permit | A valid provisional residence permit, or MVV, is required for this application | 27 May 2026 |
The IND wording does not state one fixed savings or income amount in euros for the “enough money to live on” test. No universal monetary threshold should therefore be added from another immigration route.
Can someone apply before five years?
The IND says that permanent residency can sometimes be available after less than 5 years in the Netherlands under specific circumstances.
| Situation | Condition stated by the IND | Checked |
|---|---|---|
| Retirement at pension age or earlier | The person lived continuously in the Netherlands for 3 years, worked in the Netherlands during the final 12 months, and stopped working because of retirement | 27 May 2026 |
| Permanent inability to work | The person lived in the Netherlands for over 2 years, worked until becoming unable to work, and stopped for that reason | 27 May 2026 |
| Work accident or work-related illness | The person stopped because of the accident or illness and receives a WAO or WIA benefit | 27 May 2026 |
| Frontier worker | Before working in another EU/EEA country or Switzerland, the person lived and worked continuously in the Netherlands for more than 3 years, still lives there and returns to the Dutch home at least once a week | 27 May 2026 |
The work-accident or work-related-illness passage does not state a separate residence period, so one should not be imported from another exception. None of these situations guarantees approval; the stated conditions must be demonstrated.
How do you apply and pay?
A valid MVV is needed before submitting this application. The written form identifies the required documents, all documents must be collected before applying, and supporting evidence can be uploaded through the online application.
Official foreign documents must be legalised and translated into Dutch, English, French or German, where applicable.
| Filing option | Application method | Fee payment |
|---|---|---|
| Online | Use the Online application form permanent residence EU (duurzaam verblijf), log in with DigiD and upload the documents | Pay immediately through iDEAL internet banking; the page also lists iDEAL or Wero for online payment |
| Written | Download Application for a Permanent Residence Document for Nationals of the Union and their Family Members 8004, print and complete it, then send it by post | IND sends a letter explaining how to pay |
The stated application fee is €85, checked 27 May 2026. The IND page says that an applicant under 18 pays a different amount, but it does not state that separate figure on this page; the applicable fee must be confirmed before submission.
What happens after the application is submitted?
| Stage | What the IND states | Checked |
|---|---|---|
| Normal decision period | IND must decide within 90 days | 27 May 2026 |
| Extended decision period | IND may extend the period if more time is needed, for example because the application is incomplete; it will send a message | 27 May 2026 |
| Decision | The decision is delivered by letter and is either positive or negative | 27 May 2026 |
| Positive decision | The applicant receives a residence document | 27 May 2026 |
| Negative decision | No residence document is issued, but the decision can be objected to | 27 May 2026 |
| Collection | IND sends a letter when the document is ready, and the applicant must make an appointment to collect it | 27 May 2026 |
The cited guidance does not give one fixed longer deadline for an extended decision period.
What rights and obligations come with the residence document?
A holder may work freely in the Netherlands. The employer does not need a work permit, or tewerkstellingsvergunning—TWV. The back of the document states “Arbeid vrij toegestaan, TWV niet vereist”, meaning that work is permitted without a TWV.
The holder must inform IND of any changes in their situation. IND checks compliance with this obligation, and failure to meet it may result in an administrative fine.
The document’s validity is:
| Holder | Validity and renewal period | Checked |
|---|---|---|
| Adult | Valid for 10 years and renewable every 10 years | 27 May 2026 |
| Applicant under 18 | Valid for 5 years and renewable every 5 years | 27 May 2026 |
A replacement must be requested if the document is damaged, lost or stolen. An extension can be requested when it is close to expiry. The cited IND page explains Netherlands work and compliance obligations; it does not establish what rights the document may create in another country.
This is general information, not a file-specific assessment. Confirm the current requirements with IND or the relevant immigration authority or consulate before submitting an application.
Frequently asked questions
Does living in the Netherlands for five years guarantee permanent residency?
No. The standard route also requires an eligible citizenship or family link, work during the period or enough money to live on, a valid travel document, BRP registration and a valid MVV. The 5-year threshold was checked against IND guidance on 27 May 2026.
Can a family member qualify without EU, EEA or Swiss nationality?
Yes. The IND page covers another-nationality family members of a Union citizen. It also covers family members and ex-partners of a Dutch national who comes under EU law, subject to the listed relationship and residence conditions.
Can an application be made in less than five years?
Sometimes. The IND lists retirement, permanent inability to work, work accident or work-related illness, and qualifying frontier-worker situations. These are specific exceptions rather than automatic approval routes.
Can I assume the €85 fee and 90-day period apply to ordinary Dutch permanent residence?
No—not on the basis of this IND page. The €85 fee and normal 90-day decision period belong to the EU/EEA/Swiss permanent-residency route described here, checked 27 May 2026. The source does not state the ordinary Dutch process’s corresponding fee or timing.
How long is the residence document valid?
It is valid for 10 years for an adult and 5 years for an applicant under 18, with renewal periods matching those validity periods. Both periods were checked on 27 May 2026.
